EULA
IMPORTANT – READ CAREFULLY: This End User License Agreement ("EULA") is a legal agreement between you (either an individual or a single legal entity) and Savinien GODINEAU ("Publisher") for the NtE (Nessus To Excel) software, which includes computer software and may include associated media, printed materials, and "online" or electronic documentation ("Software").
BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THE TERMS OF THIS EULA, DO NOT INSTALL OR USE THE SOFTWARE.
1. GRANT OF LICENSE
The Software is licensed, not sold. Upon payment of the applicable license fee, the Publisher grants you a revocable, personal, non-exclusive, and non-transferable license to install and use the Software strictly in accordance with the terms of this EULA.
Single-Machine Restriction: Your license key is strictly tied to the specific hardware on which the Software is first activated. The Software uses a hardware identifier (hardwareId based on motherboard UUID) to verify license validity. You may not share, distribute, or use a single license key concurrently on multiple machines.
2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
Reverse Engineering: You may not reverse engineer, decompile, disassemble, or attempt to discover the source code of the Software, except and only to the extent that such activity is expressly permitted by applicable law notwithstanding this limitation.
Bypassing Security: You may not modify, patch, or otherwise attempt to circumvent the licensing verification mechanism or the communications between the Software and the Publisher's license servers.
Distribution: You may not rent, lease, lend, sell, redistribute, or sublicense the Software or your license key.
3. INTELLECTUAL PROPERTY RIGHTS
All title, copyrights, and other intellectual property rights in and to the Software are owned by the Publisher. The Software is protected by copyright laws and international copyright treaties.
4. PRIVACY AND CONNECTIVITY
The Software operates locally to process your Nessus files; however, it requires an internet connection to activate and validate your license key against the Publisher's servers. By using the Software, you consent to the transmission of your license key, your IP address and your hardware identifier (hardwareId) for the sole purpose of license validation and fraud prevention, as detailed in our Privacy Policy.
5. DISCLAIMER OF WARRANTIES ("AS IS")
THE SOFTWARE IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. THE PUBLISHER EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The Publisher does not warrant that the functions contained in the Software will meet your requirements, that the operation of the Software will be uninterrupted or error-free, or that the extractions of audit data or vulnerabilities will be completely accurate.
6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE PUBLISHER BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, CORRUPTION OF AUDIT DATA, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF THE PUBLISHER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In any case, the Publisher's entire liability under any provision of this EULA shall be limited to the amount actually paid by you for the Software license.
7. TERMINATION
Without prejudice to any other rights, the Publisher may terminate this EULA if you fail to comply with the terms and conditions herein. In such an event, your license key will be revoked, and you must destroy all copies of the Software in your possession.
8. GOVERNING LAW
This EULA is governed by the laws of France. Exclusive jurisdiction and venue for any dispute arising out of or relating to this EULA shall lie in the competent courts of France.
