TERMS AND CONDITIONS OF SALE AND USE
Preamble: Role of the Merchant of Record
The NtE (Nessus To Excel) software is sold through LemonSqueezy, LLC, acting as the Merchant of Record. Consequently, all financial transactions, VAT collection, invoicing, and payment management are subject to LemonSqueezy's own Terms of Service, accepted at checkout. These conditions exclusively govern the delivery, refund policy, support, and responsibilities related to the use of the NtE software.
Article 1: License Key Delivery
The delivery of the NtE software is strictly digital. Upon payment confirmation by LemonSqueezy, the customer immediately receives an email containing a unique license key. It is the customer's responsibility to provide a valid email address during the order process.
Article 2: Waiver of Right of Withdrawal (Refund Policy)
Due to the digital nature of the NtE software (digital content not supplied on a tangible medium), and in accordance with European regulations, the customer expressly waives their 14-day right of withdrawal the moment the license key is activated within the software.
If the key has not been activated: a full refund can be requested within 14 days of purchase by contacting support@nte-app.com.
If the key has been activated (verifiable on our license servers): the sale is considered final and binding. No refunds will be granted.
Article 3: No Guarantee of Results ("As Is" Clause)
The NtE software is provided "as is" and "as available", without any express or implied warranty of any kind.
The Publisher (the developer of NtE) does not guarantee in any event:
That the software will function without interruption or be free of bugs, errors, or vulnerabilities.
That the results, extractions, or reports generated from Nessus files will be accurate, complete, or tailored to the customer's specific needs or particular compliance standards.
The use of data generated by NtE is at the customer's sole risk. It is the responsibility of the auditor or user to manually verify the accuracy of the vulnerability extractions.
Article 4: No Guaranteed Technical Support
Purchasing a license for NtE does not include any Service Level Agreement (SLA) regarding technical support.
Support is provided at our sole discretion and on a "best effort" basis.
The Publisher does not guarantee any response time to support requests, nor does it commit to fixing reported bugs or developing features requested by users.

Article 5: Extreme Limitation of Liability
To the fullest extent permitted by applicable law, the Publisher of NtE disclaims all liability for any direct, indirect, incidental, special, or consequential damages arising out of the use or inability to use the software.
This includes, but is not limited to:
Loss of audit data, file corruption.
Loss of revenue, contracts, or working time (e.g., software crash during a critical audit mission).
In any event, should the Publisher be held liable for any reason whatsoever, the total and cumulative compensation shall in no case exceed the actual amount paid by the customer for the purchase of the NtE software license.
Article 6: Governing Law and Jurisdiction
These conditions are governed by French law. In the event of a dispute between professionals, and failing an amicable resolution, the courts within the jurisdiction of the Publisher's registered office shall have exclusive jurisdiction.
